AVIOR PERFORMANCE LLC
Legal Disclaimer & Product Liability Terms
1. Product Selection, Installation & Safe Use
Choose products suitable for your vehicle and intended application. Use a qualified automotive technician, follow supplied instructions, and maintain safe mounting and clearance. Stop using any damaged or unsafe component. You accept the risks arising from your own misuse, negligent installation, or unauthorized alterations.
2. Lawful Applications & Emissions Compliance
Before ordering, confirm that the proposed installation and use comply with applicable emissions, noise, equipment, and registration requirements. Products identified as restricted to competition, off-road, or display applications must not be used beyond those lawful applications.
An “off-road only” or “competition use” description does not itself create an exemption from emissions laws. Nothing in these terms authorizes prohibited emissions tampering or the unlawful manufacture, sale, installation, or use of defeat devices. Customer responsibilities do not eliminate Avior Performance LLC’s own legal obligations.
3. Vehicle Changes & Product Representations
Do not assume an aftermarket component carries the same safety approvals or crash protection as the original equipment. Never obstruct or disable a vehicle safety system.
Sound and performance depend on vehicle configuration and operating conditions. No specific result is promised except as expressly represented in the applicable product description or agreement. Check relevant warranty and insurance requirements before modifying your vehicle.
4. Warranty Coverage & Excluded Damage
Applicable product warranties govern their stated coverage and duration. To the extent permitted by law and consistent with those warranties, coverage excludes damage caused by improper installation, impacts, unauthorized cutting or welding, inadequate clearance, or improper care.
For exhaust components, excluded damage includes damage caused by flame-producing tunes, excessive fueling, sustained overheating, or other abusive operation. These exclusions concern damage attributable to the excluded condition; they do not cancel unrelated coverage, contradict express product promises, or eliminate statutory warranty rights.
Contact Avior Performance LLC with your order information, photographs, and a description of the concern before arranging a warranty repair.
5. Limits on Financial Recovery
TO THE EXTENT PERMITTED BY LAW, AVIOR PERFORMANCE LLC’S TOTAL LIABILITY FOR ECONOMIC LOSS ARISING FROM AN AFFECTED PRODUCT WILL NOT EXCEED THE AMOUNT PAID FOR THAT PRODUCT. REPAIR, REPLACEMENT, OR REFUND MAY BE PROVIDED AS REQUIRED BY THE APPLICABLE WARRANTY OR LAW.
WHERE LEGALLY PERMITTED, AVIOR PERFORMANCE LLC EXCLUDES INDIRECT OR CONSEQUENTIAL ECONOMIC LOSSES, INCLUDING LOST BUSINESS INCOME, RENTAL EXPENSES, TOWING, AND VEHICLE DOWNTIME.
These limits do not restrict personal injury claims, liability for fraud, gross negligence or intentional misconduct, or rights that cannot lawfully be limited. If a limited remedy fails its essential purpose, remedies available under applicable law remain available.
6. Claims Caused by Customer Conduct
Where permitted by law, you agree to indemnify Avior Performance LLC and its personnel against third-party claims and reasonable related legal expenses to the extent caused by your negligent installation, misuse, unauthorized alterations, or unlawful conduct. This obligation does not cover Avior Performance LLC’s own fault.
7. Delivery Inspection
Inspect delivered goods promptly. Photograph shipping damage, keep the packaging, and notify Avior Performance LLC so the issue can be investigated. Follow any applicable carrier claim procedures. This inspection request does not eliminate rights provided by law.
8. Applicable Agreements & Customer Acceptance
These terms operate alongside the product description, applicable warranty, and order policies disclosed before purchase. A specific written agreement controls if it conflicts with these general terms.
Texas law governs, subject to mandatory protections that apply in the customer’s jurisdiction. If one provision is unenforceable, the remaining provisions continue to apply where lawful.
When you expressly accept these terms during checkout or in a signed order agreement, you acknowledge reviewing and agreeing to them.
